Reasons to Make a Medical Negligence Claim


If you believe that you have suffered injury at the hands of a doctor, surgeon or other medical profession you might be wondering whether it is the right thing to do to make a medical negligence claim. This article looks at some of the reasons why you might consider making a claim for medical neligence.

1. Further Treatment
If you have had surgery or treatment which has led to you suffering, you might need further remedial treatment to improve your condition. Will you want to return to the same treatment provider that caused your pain in the first place to receive this treatment? For most people, if they feel the doctor or surgeon acted negligently which originally led to their pain and suffering, they will not want the same person to treat them again.

If you decide to pursue a medical negligence claim and your claim is ultimately successful, or the insurance company for the surgeon or doctor agree responsibility, you can recover the costs of any private medical treatment that was necessary as a result of the original act of negligence. Therefore, making a claim could allow you to receive treatment privately and from somebody other than the original person.

2. Prevent Other People Suffering
If your doctor or surgeon made a mistake with you, what is to stop them making the same mistake over and over again, inflicting more pain and suffering on other innocent victims? One way is to pursue a medical negligence claim. This will alert the hospital or surgery to the act in question and they will be able to ensure that the same mistakes to not happen again. If you decide not to pursue a claim then it is unlikely that the need for retraining will be picked up.

3. Retraining
Another reason to consider making a medical negligence claim follows on from the reason above. If more than one person is making the same mistake in a hospital or other medical organisation, and this mistake is drawn to their attention by letters of complaint, the medical body can immediately take action and provide any retraining that is necessary to prevent the same mistakes from happening again.

4. Compensation For You
If your claim is ultimately successful you will receive compensation for your pain and suffering, losses and expenses. The purpose of this compensation is to put you back in the position you were in before the negligence. Whilst this is almost impossible, the fact that you will receive compensation will provide you with some closure on the incident.

5. Striking Off
If one medical professional acts negligently on more than one occasion they can be struck off. Whilst most people would not would wish this to happen to anyone, if someone is consistently acting negligently and causing pain and suffering to innocent victims, it might be the only way to stop it from happening again. This will only take place as a last resort or due to gross incompetence, so on most occasions retraining will be sufficient.
